Private Security Agencies are companies founded with the goal of providing security services to enterprises in a variety of areas, such as banking, information technology, finance, and manufacturing.

 

PSARA was established in 2005 to develop a professional standard in the sector of security services. A PSARA licence is required for agencies to operate legally. These organisations not only provide security services, but they also provide training for aspiring security professionals.

What is PSARA License?

The Private Security Agencies Act of 2005 governs and administers all regulations pertaining to security agency operations. PSARA is the common name for this act. According to this Act, no one can start or run a Private Security Agency without first acquiring a PSARA licence. The PSARA License is issued by the state’s controlling authority.

 

In 2005, the PSARA (Private Security Agencies Regulation Act) was passed. PSARA 2005 covers the following stated issues:

Documents required for PSARA License

The following certificates of registration:

  • PAN Card Information.

  • ESIC (Employees State Insurance Corporation) Registration.

  • GSTIN Information.

  • Shops and Establishments Act.

  • Labour Act registration is required.

  • Proof of the directors’ and workers’ identities.

  • Copies of the Directors’ Income Tax Returns.

  • Two passport-size photographs of the promoters, as well as their PANs are required.

  • Proof of the Agency’s Office Address.

  • Security training affidavit pursuant to Section 7 (2) of PSARA, 2005.

  • Memorandum of Understanding (MOU) with the training institute signed certificate of incorporation.

Eligibility Criteria for PSARA (Private Security Agency Regulation Act) License

  • For Companies

Below are the entities that are eligible for the License:

  1. LLP (Limited Liability Partnership)

  2. Sole Proprietorship

  3. OPC (One Person Company)

  4. Private Limited Company

  5. Partnership Firm

  6. Association of Persons

  • For the role of Director / Principal officer

The qualification to be a Director/Principal Officer is not open to everyone. To be eligible for the same, you must meet the following requirements: –

  1. Citizenship in India is required.

  2. Director/officer must be at least 18 years old to apply.

  3. Must have sufficient financial resources to cover business expenses.

  4. He must be completely free of any convictions.

  • For the role of a Security Guard

Checking the following boxes will increase your chances of landing a security guard position:-

  1. Citizenship in India is required.

  2. A person must be between the ages of 18 and 65.

  3. Prior experience is required.

  4. In any circumstances, must not be fired from any government position.

  5. Must possess all of the desired physical characteristics.

  6. It is necessary to convey assurance about the individual’s character.

Procedure for PSARA Registration

  • Gather all the necessary documents

The relevant documents for the application must be collected and sorted in order to ensure that the application is processed quickly and smoothly, which will accelerate the process of acquiring the licence.

 

To avoid any discrepancies, the paperwork relating to the numerous registrations and details of the directors and promoters must be legitimate and in an appropriate format. The application can be filed electronically on the official portal once all of the relevant documents have been gathered. The presence of a digital signature streamlines and simplifies the registration process.

  • Create MOU (Memorandum of Understanding)

A Memorandum Of Understanding (MOU) must be signed by the applicant and a certified training institute. The list of qualifying institutions can be found on the government’s official website. The short-listed individuals will receive the necessary training from these institutes. Ex-servicemen are given some leeway when it comes to the agency’s training.

  • Filing of Standard Application

After completing all of the preceding stages, the applicant must submit an application (Form-I) to the appropriate state body. Form-II must be used to attest the said form (application for verification of antecedents). Form-I must be submitted with the Form-III affidavit.

  • Police Verification Process

The applicant must complete Form-I in order to begin the police verification process. Regardless of whether the agency is a corporation or a partnership, the nominated directors must undertake police verification.

If the application is supported by a No Objection Certificate (NOC) from the police following verification, the authority will review it and either issue or refuse the PSARA License in Form-IV, depending on the circumstances.

  • Time period for getting PSARA License

Starting from the date of filing the PSARA application, the entire process of getting the PSARA License will take sixty days. The PSARA License application process differs from state to state.

  • Supervisor Appointment

In order to comply with the provisions of the PSARA, 2005, the applicant must designate supervisors. The supervisors are in charge of overseeing and directing the agency’s activities in respect to the security guards’ work. Individuals with at least three years of work experience in the army or navy must be appointed as supervisors.
