Laws Surrounding Leave Policy in India

The Factories Act, 1948, The Shops and Establishment Act, The Maternity Benefit Act, 1961, The Paternity Benefit Act, 2017, and The Industrial Disputes Act, 1947 are the key laws governing leave policy in India. The Factories Act mandates that employees are entitled to a minimum of 12 days of casual leave, 15 days of earned leave, and 12 days of sick leave in a year. The Shops and Establishment Act varies from state to state, but most states mandate that employees are entitled to a minimum of 12 days of casual leave and 15 days of earned leave in a year.

 

The Maternity Benefit Act mandates that female employees are entitled to 26 weeks of maternity leave, along with nursing breaks and medical allowances. The Paternity Benefit Act mandates that male employees are entitled to 15 days of paternity leave, while The Industrial Disputes Act provides for the settlement of disputes between employers and employees and mandates that employees cannot be terminated during their leave period.

  • It increases productivity, improves employee retention, fosters a positive work environment, and ensures legal compliance.
