ITIN Application: Requirements, Documents and Process
Introduction
An Individual Taxpayer Identification Number, or ITIN, is a nine-digit tax processing number issued by the Internal Revenue Service, or IRS. It is for individuals who need a U.S. taxpayer identification number for a federal tax purpose but are not eligible to obtain a Social Security Number, or SSN. An ITIN application is therefore based on an individual’s tax circumstances, not simply on nationality, investment plans, or ownership of a U.S. business.
An ITIN is for federal tax purposes only. It does not provide immigration status, authorize employment in the United States, or create eligibility for Social Security benefits. It is not issued solely for opening bank or investment accounts, e-commerce, or starting a business.
Quick Insights on ITIN Application
- ITIN is a 9-digit tax processing number issued by the IRS for eligible individuals who cannot obtain an SSN.
- An ITIN application generally requires Form W-7, identity documents, and a federal tax return unless an exception applies.
- A valid passport can generally establish both identity and foreign status for an ITIN applicant.
- Foreign individuals, including applicants from India, can submit an ITIN application from outside the United States.
- An ITIN is only for federal tax purposes and does not provide work authorization, immigration status, or Social Security benefits.
Let’s Understand ITIN and Its Uses for Taxpayers
An ITIN allows certain individuals who cannot obtain an SSN to meet U.S. federal tax obligations. Depending on the facts, a person may need one to file a federal income tax return, report income, claim a refund or allowable tax benefit, satisfy withholding or reporting requirements, or claim an applicable tax treaty benefit.
The need for an ITIN application must be connected to a recognized federal tax purpose. Forming a U.S. LLC or obtaining an Employer Identification Number, or EIN, does not automatically create an ITIN requirement. An EIN identifies a business or other entity for federal tax administration, while an ITIN identifies an individual for federal tax purposes.
ITIN Application Eligibility: Who Needs an ITIN?
A person generally considers an ITIN application when two conditions are met: the individual has a federal tax purpose and is not eligible for an SSN.
The IRS lists situations involving certain nonresident aliens filing U.S. federal tax returns, certain resident aliens filing returns, and qualifying spouses or dependents. Certain students, professors, researchers, and nonresident aliens claiming treaty benefits may also qualify in specified circumstances.
Eligibility is not automatic because someone earns U.S.-source income or owns an interest in a U.S. company. The federal tax purpose and SSN eligibility should be checked first.
Individual Taxpayer Identification Number (ITIN)Application Requirements
A standard ITIN application generally requires Form W-7, documents establishing identity and foreign status, and a U.S. federal income tax return. The IRS provides specific exceptions under which a return does not have to be attached if the applicant submits the required exception documentation.
Information on Form W-7 and the supporting documents must be accurate and consistent. Applicants should use their legal name, correct date of birth, citizenship information, foreign address where applicable, and the correct reason for applying.
A person who is eligible for an SSN should not submit an ITIN application instead.
Documents Required for an ITIN Application
The IRS currently recognizes 13 types of supporting documents that can establish identity and foreign status. Documents generally must be originals or copies certified by the agency that issued them. Ordinary notarized photocopies are generally not accepted for a standard ITIN application.
A valid passport is the only document that can generally establish both identity and foreign status by itself. Without a passport, the applicant generally needs at least two acceptable documents, with at least one containing a photograph.
Other accepted documents include certain national identification cards, foreign driver’s licenses, civil birth certificates, foreign voter registration cards, and U.S. visas.
Certain dependent applicants must also prove U.S. residency. A passport can do so when it includes the required U.S. date of entry. Otherwise, another acceptable residency document may be needed, subject to limited IRS exceptions.
What Is Form W-7 for an ITIN Application?
Form W-7 is used to apply for a new ITIN or renew an expired ITIN when there is a federal tax purpose.
For a new ITIN application, the applicant must select the correct reason for applying. The form covers situations such as nonresident aliens claiming treaty benefits, nonresident aliens filing federal returns, resident aliens filing returns, and certain spouse, dependent, student, professor, or researcher situations.
The selected category matters because supporting evidence can vary by filing reason.
How to Apply for an ITIN?: Step-by-Step Process
Step 1: Confirm Eligibility
Confirm that you have a federal tax purpose and are not eligible for an SSN. Do not apply merely because you formed a U.S. business or want a U.S. tax number.
Step 2: Complete Form W-7
Complete the current Form W-7 and select the correct reason for applying.
Step 3: Prepare Supporting Documents
Collect acceptable documents proving identity and foreign status. Make sure they satisfy the IRS rules for originals or issuing-agency-certified copies.
Step 4: Prepare the Federal Tax Return
In most cases, attach the appropriate federal tax return to the ITIN application. If an IRS exception applies, provide the exact documentation required for that exception.
Step 5: Submit the Application
Send the complete package using an IRS-approved method and the address or channel specified for Form W-7.
Step 6: Review the IRS Notice
The IRS may assign an ITIN, request more information, or reject the application. Respond promptly if additional information is requested.
How to Submit an ITIN Application to the IRS
Applicants may mail an ITIN application to the IRS address in the current Form W-7 instructions. Participating IRS Taxpayer Assistance Centers and select VITA sites also provide ITIN services.
Applicants can also use an IRS-authorized Certifying Acceptance Agent, or CAA, which can review Form W-7 and authenticate most permitted documents. An Acceptance Agent can assist with filing but does not have the same authentication authority.
How to Apply for an ITIN from India
A person living in India can complete an ITIN application from abroad if the IRS requirements are met. The IRS accepts Form W-7 applications from outside the United States.
An applicant can mail the package with the required tax return or exception documentation and acceptable identity documents. An eligible applicant can also work with an IRS-authorized CAA abroad.
Indian entrepreneurs should separate personal tax identification from business registration. Registering a U.S. company does not automatically mean its owner needs an ITIN. For related guidance, see our Company Registration in USA service and guide on how to apply for ITIN from India.
Can You Submit an ITIN Application Without a Tax Return?
Generally, a new applicant files Form W-7 with a U.S. federal income tax return. The IRS recognizes limited exceptions, but an applicant relying on one must meet its conditions and provide the supporting documents specified in the Form W-7 instructions.
These exceptions cover certain third-party withholding, passive income, tax treaty, mortgage interest, U.S. real-property disposition, and other specified federal tax situations.
Effective June 1, 2026, CAAs submitting Form W-7 under Exception 1(a) Partnership must include the relevant portion of the partnership or LLC agreement showing the partnership name, EIN, and applicant’s name and signature. It must also show that the applicant is a partner in a partnership conducting business in the United States.
ITIN Application Processing Time
The IRS advises allowing about seven weeks for written notification of ITIN application status. It can take up to 11 weeks when the application is submitted during peak tax time, from January 15 through April 30, or from abroad.
If original supporting documents are mailed, the IRS states that they can take up to 60 days to be returned. Missing information, unclear documents, or an IRS request for additional information can lengthen processing.
Common ITIN Application Mistakes to Avoid
Common mistakes include selecting the wrong Form W-7 reason, providing incomplete or insufficient documents, or failing to attach the required federal tax return or valid exception evidence. Ordinary photocopies should not be used where originals or issuing-agency-certified copies are required, and dependent applicants must check separate U.S. residency rules.
Another mistake is assuming every foreign U.S. business owner needs an ITIN application. The IRS specifically states that an ITIN is not issued solely for opening bank or investment accounts, e-commerce, or starting a business.
ITIN vs SSN vs EIN: What Is the Difference?
An ITIN is issued by the IRS to an individual who needs a taxpayer identification number for a federal tax purpose but is not eligible for an SSN. An SSN is issued by the Social Security Administration to eligible individuals. An EIN is issued by the IRS primarily to identify businesses and certain other entities for federal tax administration.
A foreign owner can have a U.S. entity with an EIN without automatically needing an ITIN application. If your requirement is a business tax ID, see our EIN Application in the USA service.
Does an ITIN Expire and When Should It Be Renewed?
An ITIN expires if it is not used on a U.S. federal income tax return at least once during three consecutive tax years. It expires on December 31 after the third consecutive year of non-use. ITINs assigned before 2013 that were never renewed have also expired.
An expired ITIN generally needs renewal only when there is a federal tax filing purpose. Renewal uses Form W-7 together with the required tax return or other federal tax-purpose documentation and identification documents.

Conclusion
An ITIN application is appropriate only when an individual has a valid U.S. federal tax purpose and is not eligible for an SSN. Most applicants must submit Form W-7, acceptable proof of identity and foreign status, and a federal tax return unless a specific IRS exception applies.
Applicants from India can apply from abroad, but business ownership alone does not create an ITIN requirement. Before submitting an ITIN application, check current IRS guidance and ensure the filing reason and documents are accurate.
Frequently Asked Questions
1. What happens if my passport expires while my ITIN application is being processed?
If the passport or other supporting identification document was valid when the ITIN application was submitted, its later expiration during IRS processing does not necessarily make the application invalid. The IRS reviews whether the document was current when submitted.
2. Can a Certifying Acceptance Agent verify all documents for an ITIN applicant?
No. A Certifying Acceptance Agent can authenticate most permitted identity documents, but special rules apply to dependents. For certain dependent documents, originals or copies certified by the issuing agency may still need to be submitted to the IRS.
3. Can someone apply for an ITIN before receiving a U.S. pension or annuity?
A qualifying nonresident alien may apply once they become entitled to receive a pension or annuity payment that is subject to U.S. information reporting or withholding. Supporting evidence from the withholding agent is required under the applicable Form W-7 exception.
4. Can an ITIN be issued for a dependent even if claiming the dependent does not reduce the tax payable?
In certain situations, yes. Eligibility depends on whether the dependent meets the applicable federal tax rules and is being claimed for an allowable tax benefit, rather than only on whether the claim ultimately reduces the tax liability.
5. Can tax software automatically handle a dependent’s pending ITIN application?
Not always. When a dependent does not yet have an ITIN, taxpayers should carefully review the return and applicable tax-benefit entries before submitting it with Form W-7 because software may not automatically handle every ITIN-related situation correctly.
6. Can a foreign student claim U.S. tax treaty benefits through an ITIN without filing a tax return?
Certain foreign students, professors, researchers, and other qualifying nonresident aliens may apply under a Form W-7 exception when treaty benefits or withholding requirements apply. The applicant must meet the specific exception conditions and provide the required supporting evidence.
7. Can a nonresident alien obtain an ITIN for U.S. gambling winnings?
Yes, in qualifying situations. Form W-7 Exception 2(d) addresses certain nonresident aliens claiming treaty benefits related to gambling winnings, subject to the documentation and withholding requirements specified by the IRS.
8. Can an ITIN Acceptance Agent interview an applicant through video conferencing?
Yes. The IRS permits video conferencing for the interview. However, when a Certifying Acceptance Agent authenticates identification documents, the agent must have the original documents or issuing-agency-certified copies in their possession during the interview.
9. Can an ITIN be used to open a U.S. bank account?
Some U.S. banks may accept an ITIN as part of their account-opening requirements, but acceptance depends on the individual bank’s policies and any additional identification or compliance documents it requires. An ITIN itself does not guarantee account approval.
10. Will I receive a physical ITIN card after approval?
No. The IRS does not issue a physical ITIN card like a Social Security card. Once an ITIN is assigned, the IRS communicates the number to the applicant through an official notice or letter.
File an ITIN Application
One of the essential requirements for foreign business owners in the USA is to get an Individual Taxpayer Identification Number (ITIN).
