Introduction
According to the New Telecom Policy (NTP) 1999, service providers in India who use Telecom resources to provide services such as telebanking, telemedicine, tele-education, tele-trading, e-commerce, call centre, network operation centre, and other IT Enabled Services are referred to as “Other Service Providers” (OSP). These Other Service Providers, or OSPs, are required by the Department of Telecommunications (DOT) to obtain an OSP Registration. We will look at the process for obtaining OSP License Registration in India, Document requires for OSP License and types of OSP (Other Service Providers) in this article.
Types of OSP (Other Service Providers)
-
Domestic OSP
Domestic OSPs provide telebanking, teletrading, telemedicine, e-commerce, network operation centre, call centre, and other IT enabled services within national boundaries, i.e. within India.
-
International OSP
International OSPs provide telebanking, teletrading, telemedicine, e-commerce, network operation centre, call centre, and other IT enabled services beyond national boundaries, i.e. outside India.
Documents required for OSP License Registration in India
To obtain an OSP Registration in India, the entity must be a Private Limited Company. As a result, entrepreneurs planning to start a call centre, BPO, e-commerce, or other IT Enabled Services must incorporate a Private Limited Company. In addition to the application in the prescribed format, the following documents are required for OSP Registration:
- MOA and AOA of a company
- Present Shareholding
- List of Directors
- Authorizing the Authorized Signatory: Board Resolution or Power of Attorney
- Incorporation certificate of Private Limited Company
- Business name and activity
Important Note: A Company Secretary, Director of the Company, Statutory Auditor, or Public Notary must certify the above-mentioned documents under seal.
Process for obtaining OSP License in India
The Department of Telecommunications must issue the domestic or international OSP with an OSP Registration/License (DoT). The following is the procedure for obtaining OSP Registration for both domestic and international OSP:
- Companies registered under the Companies Act of 1956 or the Companies Act of 2013 are eligible for OSP Registration.
- Form-I should be used to apply to the DoT for OSP Registration. It is possible to apply for it online at the Department of Transportation’s website.
- The OSP Registration is limited to a single location. As a result, a company can have multiple OSP Registrations.
- The company should apply for OSP Registration for one site for multiple registrations. Following the receipt of the registration certificate for the first location, the company may apply to the appropriate authorities for the remaining sites.
- If the company wishes to change or add a Point of Presence (POP), it must notify the DoT.
- The processing feed needs to be paid along with the process of OSP (Other Service Providers) registration application.
Bottom Line
To maintain OSP registration compliance, an OSP must file a “Annual Return” with the DoT within 6 months of the end of a fiscal year. The Return should include the OSP’s current status and activities. The OSPs must adhere to the terms specified by the DoT.
Private Limited Company
