What is the Trademark Registration Process?
The trademark registration process in India is a legal procedure governed by the Trade Marks Act, 1999, designed to protect your brand name, logo, symbol, slogan, or design from misuse. A registered trademark gives you exclusive ownership rights and ensures that no one else can legally use or imitate your brand identity.
In India, the registration process is completely online and managed by the Controller General of Patents, Designs, and Trademarks (CGPDTM), under the Ministry of Commerce & Industry. It follows a systematic series of steps — beginning with a trademark search, application filing, examination, publication, and finally, registration.
Before filing, an applicant must perform a trademark search to confirm that their proposed brand name or logo is unique. This is done by checking the Trademark Registry database to ensure it doesn’t conflict with an existing registered or applied trademark. Each product or service is classified under a specific Trademark Class (out of 45 classes defined by the NICE Classification system). Selecting the correct class is essential, as it determines the scope of legal protection.
Once the application is filed, the Trademark Office assigns an application number, which allows you to use the ™ symbol immediately to indicate that your trademark is under process. The application then undergoes examination by the Registrar, where it is reviewed for any technical or legal issues. If any trademark objection is raised, a formal reply must be submitted within the stipulated time to continue the process.
If the Registrar accepts the application, it is published in the Trademark Journal for four months, giving the public a chance to oppose if they believe it conflicts with their brand. If no opposition is received, or if the applicant successfully defends it, the mark proceeds to registration, and a Trademark Registration Certificate is issued. The applicant can then legally use the ® symbol, confirming full ownership rights over the brand.
