What is Food License / FSSAI License?

The FSSAI stands for Food Standards and Safety Authority of India, which is the supreme authority responsible for regulating and supervising food safety. The Food Safety and Standards Authority of India (FSSAI) is a legal authority that offers a food license to all food business operators (FBO) in India. All the FBOs must follow all the rules and regulations of FSSAI for food quality control.

 

Any legal entity involved in handling food items must obtain an FSSAI Food License before starting a food business. This includes businesses engaged in manufacturing, repacking, re-labeling, storage, warehousing, transporting, supplying, wholesaling, marketing (trading), retailing, e-commerce (online food sales), exporting, importing, catering, operating canteens, dhabas, restaurants, hotels, and more. In FSSAI terms, these entities are referred to as Food Business Operators (FBO).

Validity for FSSAI License

  • FSSAI licenses issued to food businesses are valid for a period of 1 to 5 years as chosen by the Food Business Operator.
  • It is mandatory to apply for license renewal 30 days before the expiry of the existing license.
  • Non-renewal of licenses can fetch a fine of Rs.100 per day until the renewal is done .

Who are required to apply for FSSAI license / Food Licence in India

  • All food businesses having income less than 12 lakh are required to take an FSSAI registration.
  • FBO (Food Business Operators) who has a business as a retailer, supplier, distributor, wholesaler, and, food vending establishments. And also a business of canteen, club, Dhaba, restaurants, and hotels with an annual turnover of less than Rs. 12 lakh.
  • Petty food manufacturer.
  • Small stalls selling food items.
  • Businesses involved in selling food for religious and social gathering.
  • Cottage industries that are selling food items.
  • Production or processing units of vegetable oil and refineries include oil expelling system. The capacity has to be less than 100 kg/liter a day (except meat or milk).
  • Dairy units involved in /collection/ procurement / chilling/handling of milk, having a capacity has to be less than 500 liters a day or up to 2.5 Metric Ton of milk solids.
  • Slaughter shops having not more than 2 large animals or 50 poultry birds or 10 small animals in a day.

Documents required for Food License / FSSAI License in India

Common Documents for All Types of FSSAI Registrations  

  • Form A or Form B (Form A – for Basic FSSAI Registration & Form B – for State or Central FSSAI Registration)
  • 2 Passport Sized Latest Photographs
  • PAN Card of the Business Owner/Proprietor/Partner/Director
  • Proof of the Possession of the Premises (Property Papers-if property is owned, Utility bills (Electricity or water) or Rent Agreement – if property is rented)
  • Partnership Deed
  • Certificate of Incorporation or Articles of Association (AoA) for a company
  • A complete list of food items the business will be involved in
  • Caterers working under Central Government or related agencies such as Railways, Airlines, airports, Seaport, Defense, etc

  • A complete and signed Form B
  • Details of the Owner/Proprietor, Partners or Directors with their Photo ID, Photographs and Address Proofs
  • The layout of the proposed location, and the planned placement of the equipment
  • Possession Proof of that building/premises,
  • No Objection Certificate (NOC) from the owners. Along with their details, such as name & address,
  • Copy of License from the Manufacturers of the Equipment,
  • List and Details of the Equipment are already installed or proposed to be installed at the location,
  • Each Food Product and its category that is planned to be produced,
  • Planned Food Safety Management System (FSMS).

  • A completed and signed Form B
  • Details of the Owner/Proprietor, Partners or Directors with their Photo ID, Photographs and Address Proofs
  • Proof of Annual Turnover
  • The layout of the proposed location, along with the planned installation and placement of the equipment
  • Possession Proof for the building/premises
  • No Objection Certificate (NOC) from the owners, along with their other details, such as name & address
  • Copy of License from the Manufacturers of the Machinery & Equipment
  • List and Details of Equipment already installed or proposed to be installed at the premises
  • Each Food Product and/or category that is planned to be produced
  • Planned Food Safety Management System (FSMS)
  • Water Report Analysis by an accredited Laboratory

Private limited registration

  • Is there any provision of transferring FSSAI / Food license in India?

    If the holder of an FSSAI license passes away, the heir or legal representative can transfer the license. The representative or family member must apply to the concerned authority to have the license transferred into their name.

  • Is Food License and Restaurant License one and the same thing?

    Restaurants, eateries, and food joints are issued a Food License, often referred to as a Restaurant License. The process of obtaining a Restaurant License is the same as for any other Food License. These establishments must prominently display their FSSAI registration during business hours to ensure it is visible to customers, employees, and other stakeholders.

  • I am selling homemade stuff online on a small scale, Do I require FSSAI license?

    Yes, you do require an FSSAI registration if you have a business on a small scale and the turnover is between 0-12 lakhs.

  • What happens if an FBO is found to be Non Compliant?

    In case, an FBO is found to be Partially Compliant or Non-Compliant with the FSSAI regulations, during an inspection, the Inspecting Officer or the accredited agency may issue an Improvement Notice or suspend its Food Safety Certificate, depending upon the degree of Non-Compliance.

  • If I am selling more than one food product, do I need a license for each of them?

    Yes, you need to obtain a separate license for each product you are selling.

  • I forgot to apply for renewal of the FSSAI License. It expired 3 months back can I renew it now? Will I have to pay the penalties?

    If you didn’t apply for renewal 30 days before the expiry of your existing Food Safety Certificate, a penalty of Rs. 100 per day will be levied, during that 30 day period. In case, your FSSAI number has already expired, you will have to go through the complete process of applying for fresh registration.

  • I have a food business spread in more than one state. What should I do in this case?

    You must get a Central Food License for the Registered Head Office Branch and a State License or Registration for the branches.
